Collaborative Family Law

Oshawa Collaborative Law Practice

At Borden Family Law our Collaborative Practice is an out-of-court alternative for Separation & Divorcing couples. Separation and divorce can be a stressful and expensive process as Separating couples suddenly find themselves dealing with unfamiliar social, legal and financial issues.

less expensive than  traditional divorce

A Collaborative Practice approach brings together a team of trained legal, family and financial experts to work towards a separation agreement that is realistic and confidential that meets the interests of both spouses and their children. A collaborative divorce can be less expensive than  traditional divorce because it eliminates the need for time consuming, expensive court appearances.

At Borden and Associates our Collaborative Family Law Practice will help you:

Collaborative Family Law Resolve family law disputes without going to court or threatening to go to court
Collaborative Family Law Remain focused on the best interests of children
Collaborative Family Law Ensure full and complete disclosure of all important information
Collaborative Family Law Negotiate in a principled, dignified and respectful manner
Collaborative Family Law Explore as many options for settlement as possible
Collaborative Family Law Reach creative resolutions that best meet the goals and priorities of the individual family.

put the children’s needs first

When a couple chooses a Collaborative Practice approach to their separation they each will hire a Collaboratively trained lawyer. After initial meetings a decision will be made regarding the needs of additional Collaborative experts such as child experts or financial specialist to work alongside in the process. The spouses and their chosen professionals sign a Participation Agreement to act in good faith, disclose all relevant information, put the children’s needs first, and look for mutually acceptable solutions. Negotiations will take place during the settlement meetings where information is exchanged and all options considered. Mutual problem-solving by all the parties leads to the final divorce agreement.
